McKool Smith represented Medtronic Inc. and one of its subsidiaries against Boston Scientific based on claims that Boston Scientific’s Taxus Express2, Express2, Liberte, Maverick, Maverick2, and Quantum Maverick products infringed the Fitzmaurice and Anderson catheter patents owned by Medtronic. After a week-and-a-half trial and five hours of deliberations, the jury in the U.S. District Court for the Eastern District of Texas awarded Medtronic a verdict ranked as the 12th largest jury verdict in the country for 2008 according to VerdictSearch. Post-trial the verdict was reduced.
