McKool Smith helped secure a verdict and eventual judgment on behalf of TiVo Inc. in a patent dispute with competitor EchoStar over a TiVo patent that allows viewers to record one television program while watching another.  The jury awarded Alviso, Calif.-based TiVo lost profits from the sale of set-top boxes and royalties that should have been paid by EchoStar on the sale of the company’s TiVo-like boxes, plus prejudgment interest and supplemental damages.  The ruling not only confirmed TiVo’s ownership of the important patents, but also cleared the way for the company to negotiate royalty agreements with other manufacturers using the same technology.
