Steven Callahan is an Associate in the Dallas office of McKool Smith.  His practice involves complex commercial and intellectual property litigation.  Mr. Callahan graduated from the University of New Hampshire summa cum laude, and attended law school at Stanford and Harvard.  At Stanford, Mr. Callahan was an editor of the Stanford Journal of International Law and offered an editor position on the Stanford Law Review.   At Harvard, he was an editor of the Harvard Journal on Legislation.  

Mr. Callahan has represented numerous clients in lawsuits involving claims of patent infringement.  He has also represented clients in cases involving allegations of theft of trade secrets, breaches of contract, product liability claims, copyright infringement, and breaches of fiduciary duty.

Representative Matters

  • Halliburton.  Mr. Callahan represented Halliburton in lawsuits brought by Kilt Resources and Main Hastings.  Kilt Resources dismissed its claims against Halliburton while Halliburton’s motion to dismiss was pending, and the Court granted Halliburton’s motion to dismiss Main Hastings’ complaint.
  • MOSAID Technologies, Inc.  Mr. Callahan currently represents MOSAID in a patent infringement lawsuit filed against, among others, Dell, Research in Motion, Asus Computer, Canon and Lexmark.  The patents-in-suit claim technology relating to 802.11 compliant Wi-Fi devices.
  • Versata. Mr. Callahan currently represents Versata in its patent infringement lawsuit against SAP. Mr. Callahan was a member of the trial team that secured a jury verdict finding that SAP infringed Versata's patent, which claims pricing technology, and awarding Versata lost profits and reasonable royalty damages.  Versata also obtained a permanent injunction enjoining the sale of SAP’s infringing products. 
  • Affiliated Computer Services, Inc. Mr. Callahan currently represents Affiliated Computer Services, Inc. in a case brought by United.com, Inc. d/b/a Instant Bank in the District of Delaware. Instant Bank’s complaint includes breach of contract and copyright infringement claims.
  • Good Technology, Inc. Mr. Callahan currently represents Good Technology, Inc. in a patent infringement lawsuit brought by SoftVault Systems, Inc. The patents-in-suit relate to remotely enabling and disabling devices such as PCs.  Mr. Callahan also represents Good Technology, Inc. in a patent infringement lawsuit filed against Excitor A/S and Little Red Wagon Technologies, Inc.  The patents-in-suit relate to technology involved in the synchronization of data with mobile devices such as smart phones.
  • Medtronic, Inc. Mr. Callahan represented Medtronic, Inc. in a false patent marking lawsuit brought by Promote Innovation LLC.  The case settled favorably to Medtronic while Medtronic’s motion to dismiss Promote’s complaint was pending.
  • MagSil Corp. & Massachusetts Institute of Technology. Mr. Callahan currently represents MagSil Corp. and the Massachusetts Institute of Technology in a patent infringement lawsuit against Hitachi. The patent-in-suit relates to tunneling magnetoresistive technology found within hard disk drives. Confidential settlement agreements were reached with Seagate Technology, TDK Corp., and Western Digital Corp. prior to the close of discovery. The case is currently on appeal to the United States Court of Appeals for the Federal Circuit.
  • Red River Fiber Optic Corp. Mr. Callahan currently represents Red River Fiber Optic Corp. in its patent infringement lawsuit against AT&T, Qwest and Verizon. The patent-in-suit relates to fiber optic technology.
  • VirnetX Inc. Mr. Callahan represented VirnetX Inc. in a lawsuit filed against Microsoft Corp. for patent infringement involving methods for facilitating and securing the creation of virtual private networks. Mr. Callahan was a member of the trial team that secured a jury verdict finding that Microsoft willfully infringed two VirnetX patents.
  • TGIP, Inc. A member of the TGIP trial team, Mr. Callahan represented TGIP in its patent infringement lawsuit against AT&T involving pre-paid telephone card technology. TGIP obtained a jury verdict against AT&T following a two week trial in the Eastern District of Texas. The case settled favorably to TGIP while on appeal to the Federal Circuit. The other defendants in the case--Verizon, IDT, and InComm--settled with TGIP shortly before trial.
