Robert Auchter is a Principal in McKool Smith’s Washington, DC office.  Prior to joining McKool Smith he was a partner in Dewey & LeBoeuf’s Washington, DC office.  He handles intellectual property litigation and commercial litigation for a variety of public and private companies and individuals.  His work before district and appellate courts and the International Trade Commission includes patent litigation encompassing computers, consumer and industrial electronics, battery technology, medical devices and instruments, automotive products, aerospace technology, satellite communications, interactive voice technologies, telecommunications, polystyrene products, and semiconductor processing, as well as trade secret misappropriation, trademark and copyright infringement and the DMCA.

He has also represented clients in trademark cancellation and opposition proceedings before the Trademark Trial and Appeal Board.  In addition to litigation, he has provided counseling on due diligence reviews, patent purchase agreements and licenses, joint development agreements, technology transfer agreements, computer software development licenses, and computer software distribution and use licenses for domestic and international clients.  Mr. Auchter has also worked as a software engineer developing graphic user interfaces using object oriented design and programming, and in network and test engineering.

Prior to joining McKool Smith:

  • ExxonMobil Chemical Company. Mr. Auchter assisted ExxonMobil in reaching resolution with a licensee on patents involving unique polymers.
  • Certification Trendz. Mr. Auchter represented Certification Trendz in copyright litigation involving Internet distribution of certification test preparation materials.
  • Clark Construction Group. Mr. Auchter represents Clark Construction Group in patent and trade secret litigation.
  • Medtronic, Inc. Mr. Auchter has represented Medtronic, Inc. in patent litigation relating to spinal surgery instruments and procedures.
  • Tulip Computers Mr. Auchter represented Tulip Computers in patent litigation relating to computer architecture.
