Brett Charhon is an Associate in the Dallas office of McKool Smith. He has worked on various litigation matters

Representative Matters

Toll Brothers.  Mr. Charhon represents Toll Brothers and five other national home builders in a case brought by Wachovia Bank, N.A. in the Southern District of New York. The suit alleges that the home builders breached completion guaranties that were executed in connection with a 1,700 acre tract of property that was purchased from the United States Department of the Interior's Bureau of Land Management for more than $500 million in 2005. 

Parrish v. NFLPA. Mr. Charhon was a member of a team that represented a class of over 2,000 retired NFL players, alleging breaches of contractual and fiduciary duties related to the licensing of the class members' images, in a lawsuit against the NFL Players Association, and its licensing subsidiary, Players Inc.  The case was tried to a jury in November 2008, and the jury returned a verdict of approximately $28M.

Holly Oil Corporation.Holly Oil Corporation v. Frontier Oil Corporation.  Mr. Charhon was a member of the litigation team that represented Holly Oil in a suit in which Frontier Oil alleged that Holly failed to perform under an agreement to merge the two companies when it invoked a material adverse change. The case was tried in the Delaware Chancery Court in February 2004, resulting in Holly being absolved of all wrongdoing.

BearingPoint, Inc. -- Mr. Charhon represents BearingPoint in commercial litigation matters.  Most recently, Mr. Charhon represented BearingPoint in an arbitration against Baylor Health Care System before the International Institute for Conflict Prevention and Resolution. 

Electronic Data Systems Corp.  Mr. Charhon is part of the litigation team that has represented EDS in several matters involving EDS' major contracts.
