Gary Kitchen is an Associate in the Marshall office of McKool Smith, with a practice concentrating on commercial litigation and intellectual property matters.

Mr. Kitchen is fluent in Spanish and has international experience in business management, market development, strategic planning and project administration. Prior to entering the practice of law, Mr. Kitchen served as an executive with AT&T and SBC both in the United States and Mexico. He is the co-author of “Genetic Engineering: Whither We Tend?“ presented at the 19th World Congress of the International Association of Law and Social Philosophy (IVR) and published in the ARSP. From 2000-2001, he served as student Editor-in-Chief for The International Lawyer, a quarterly law journal on international practice, which addresses in-depth, current issues of private and public international law, comparative law and trade law.

Representative Matters

Excel Communications. Mr. Kitchen worked on the team that represented Excel in a precedent setting, patent infringement dispute with AT&T.

Electronic Data Systems. Mr. Kitchen has worked on teams representing EDS in a variety of complex commercial disputes involving telecommunications and data services.

Pioneer Natural Resources. Mr. Kitchen worked on the team representing Pioneer in multiple, complex oil and gas disputes related to the infamous white oil controversy.

Hicks, Muse, Tate & Furst. Mr. Kitchen worked on the team representing Hicks Muse during dispute with Coho energy regarding a complex business acquisition.
