Luke McLeroy is a Principal in the Dallas office of McKool Smith with a practice concentrating on intellectual property and complex business litigation. Luke is also a registered patent attorney.
His patent litigation experience includes a multimillion-dollar jury verdict in favor of his client. He has also represented one of the world's largest telecommunications companies in a complex, multi-venue dispute involving more than 50 patents.
Representative Matters
- VirnetX. Luke represented VirnetX in VirnetX v. Microsoft, a patent infringement lawsuit related to virtual private networks. The case resulted in a multimillion-dollar verdict in favor of VirnetX following a six-day trial during which a jury found that Microsoft willfully infringed two VirnetX patents.
- Ericsson. Luke represented Ericsson in Ericsson v. Samsung, patent litigation involving more than 50 standards-essential patents with simultaneous proceedings pending in the Eastern District of Texas, the International Trade Commission, and foreign courts. The parties reached a confidential settlement agreement shortly before trial.
- i2 Technologies. Luke represented i2 Technologies in i2 Technologies v. SAP, patent litigation related to supply chain management software. SAP settled shortly after the Markman hearing with a multimillion-dollar payment to i2.
- Nortel Networks. Luke represented Nortel Networks in Ciena v. Nortel Networks, patent litigation related to the parties’ telecommunications and data networking products. The parties reached a confidential settlement agreement shortly before trial.
- Holly Corp. Luke represented Holly Corp in Frontier Oil v. Holly, litigation resulting from the parties’ failed merger agreement. After a two-week bench trial, the Delaware Chancery Court absolved Holly of all wrongdoing.
