James N. Willi is an Associate in the Austin office of McKool Smith. His practice focuses on intellectual property and complex commercial litigation involving patents, copyrights, trademarks, claims of unfair competition, and trade secret misappropriation.

His LL.M. thesis entitled "Proposal for a Uniform Federal Common Law of Attorney-Client Privilege for Communications with U.S. and Foreign Patent Practitioners" was published in the Spring 2005 issue of the Texas Intellectual Property Law Journal.

Prior to joining McKool Smith, Mr. Willi was an Associate at Dewey Ballantine and at Brobeck, Phleger & Harrison.  Before practicing law, he was as an electrical engineer for 10 years involved in system operations and planning of electrical power distribution and transmission systems.  Mr. Willi is a Licensed Professional Engineer in Texas.

Representative Matters

American Airlines, Northwest Airlines, Korean Air.  Mr. Willi defended a number of domestic and international airlines in a patent infringement case in the Eastern District of Texas. The plaintiff stipulated to noninfringement after a claim construction ruling favorable to the clients. Mr. Willi represented the airlines in the appeal before the Federal Circuit. The district court’s claim construction was affirmed.

Trilogy Software, Inc.  Mr. Willi represented Trilogy in a patent infringement case relating to computer software applications for configuration and pricing of complex products and services. Trilogy obtained a multi-million dollar settlement.

OPTi, Inc.  Mr. Will represented OPTi in a patent infringement case in the Eastern District of Texas involving computer chipsets. OPTi obtained a multi-million dollar settlement.

Nortel Networks Inc.  Mr. Willi represented Nortel in a patent infringement case relating to mobile telecommunications networking technology. The case resulted in a favorable settlement for the client.

Infineon Technologies, A.G.  Mr. Willi represented Infineon in a patent infringement case involving semiconductor memory technology. The case resulted in a favorable settlement for the client.

Ericsson AB.  Mr. Willi represents Ericsson in a U.S. International Trade Commission investigation involving seven U.S. patents relating to mobile telecommunications technology.
