Jennifer Henry is an Associate in the Dallas office of McKool Smith. Her practice deals with complex commercial litigation.
An active SMU alumnus, Mrs. Henry participates in the SMU Alumni Band, raises money for the Mustang Club Morgan Campaign, and has sat on both the Mustang Club and Diamond M Club Board of Directors.
Representative Matters
Lockheed Martin. Represents Lockheed Martin in L-3 Communications Integrated Systems, LP v. Lockheed Martin Corporation, an antitrust suit brought by L-3 involving refurbishment of P-3 fixed wing maritime surveillance aircraft by foreign governments.
i4i Limited Partnership and Infrastructures for Information Inc. Represents i4i Limited Partnership and Infrastructures for Information Inc. in a suit filed against Microsoft Corporation for patent infringement involving a method and system for manipulating architecture and content of a document separately from each other. After an eight-day trial, the jury found the patent valid and infringed, rendering a verdict in favor of i4i Limited Partnership and Infrastructures for Information Inc. On appeal to the Federal Circuit, the verdict was affirmed.
Lennox. Currently represents Lennox Hearth Products Inc., Lennox International Inc., and Lennox Industries Inc. in defense of a nationwide class action related to sale of direct vent gas fireplaces.
EDS. Represented EDS in multiple matters regarding global information technology contracts, including disputes with WorldCom, Bank of America, Xerox, the United States Navy, and GM. Also represented EDS directors and officers in claims brought by shareholders seeking to enjoin its merger with Hewlett Packard in 2008, and represented EDS in patent litigation in against DataTreasury Corporation.
Medtronic, Inc. In Alt v. Medtronic, Mrs. Henry defended Medtronic on claims of infringement of four patents regarding pacemakers and implantable cardioverter defibrillators.
Corporate Officers/Directors. In Rittenmeyer v. Donaldson Lufkin & Jenrette, Inc. et al., represented a former officer and director of AmeriServe, Inc. in defense of claims brought by AmeriServe’s litigation trustee. In Margolies v. Deason et al, represented Chairman of Precept Business Services, Inc. with respect to claims brought by shareholders.
BearingPoint, Inc. Represented BearingPoint, formerly KPMG Consulting, regarding Oracle E.R.P. software implementation claims in Schnelling v. Thomas, et al.
Texas Wesleyan University. Represented TWU on matters involving claims of students and employees of the Texas Wesleyan University Law School against the University and its administrators.
Dynacare, Inc. Represented HT/DL LP, successor to Dynacare, a medical laboratory management company, in a dispute with Health Texas regarding a contract for management of laboratories.
Oil and Gas Plaintiffs. In Shores v. Shell & Exxon Mobil and Ragland v. Shell & Exxon Mobil, represented nationwide classes in royalty underpayment matters involving the McElmo Dome in Colorado. Also represented the state of New Mexico in underpayment claims brought against various oil producers in the Bravo Dome area of New Mexico.
Dal-Tile Corp. In Dal-Tile Corp. v. Chase Manhattan Bank, represented Dal-Tile in case involving Chase’s guarantee of payment on indebtedness incurred by one of Dal-Tile’s New York distributors.
