Mitchell R. Sibley is an associate in the Dallas office of McKool Smith.  He focuses on intellectual property and commercial litigation.

While attending law school, Mitchell was Staff Editor and Articles Editor of the SMU Law Review.  He was also a Semifinalist in both the Comment Competition and Casenote Competition. 

Also during law school, Mitchell was a judicial intern for The Honorable Marcia A. Crone in the Eastern District of Texas, and The Honorable Susan Hawk in the 291st Judicial District Court in Dallas.  He also held an internship position with the Dallas County Public Defender's Office. 

Representative Matters

  • Summit 6 LLC v. Apple, Inc., et al. (N.D. Tex.) Mr. Sibley represented Summit 6 in a patent infringement lawsuit against Apple, Twitter, HTC, LG, and Motorola involving digital content processing and uploading technology.
  • Google, Inc. v. Rockstar Consortium US LP, et al. (N.D. Cal.) Mr. Sibley represented Rockstar Consortium and MobileStar Technologies LLC in a declaratory judgment action against Google, Inc. involving patents related to software and radio-frequency electromagnetic shielding technology for use in wireless telecommunications devices.
  • Rockstar Consortium US LP v. ASUStek Computer, Inc., et al. (E.D. Tex.) Mr. Sibley represented Rockstar Consortium and MobileStar Technologies LLC in a patent infringement lawsuit against Samsung, Google, ASUS, HTC, LG, Pantech, and ZTE involving patents related to software and radio-frequency electromagnetic shielding technology for use in wireless telecommunications devices.
  • Unwired Planet v. Apple, Inc. (N.D. Cal.) Mr. Sibley represented Unwired Planet in a patent infringement lawsuit against Apple involving mobile handset and networking technology.
  • Unwired Planet v. Google, Inc. (D. Nev.) Mr. Sibley represented Unwired Planet in a patent infringement lawsuit against Google involving mobile handset and networking technology.
  • Summit 6 LLC v. Research in Motion, et al. (N.D. Tex.) Mr. Sibley represented Summit 6 in a patent infringement lawsuit against Research in Motion, Facebook, Samsung, Multiply, and Photobucket involving digital content processing and uploading technology.
  • VirnetX, Inc. v. Cisco Systems, Inc., et al. (E.D. Tex.)Mr. Sibley represented VirnetX in a patent infringement lawsuit alleging infringement of VirnetX’s network security patents by Cisco, Apple, Aastra, and NEC.
