McKool Smith principal Aimee Fagan was quoted in the Law360 article, “Halliburton To Face 2nd Patent Trial In August After Hung Jury.” After six years of litigation and a federal jury trial in Houston, McKool Smith has successfully defeated contract, patent, trade secret, and fraudulent inducement claims brought against Halliburton by a former supplier. The March trial deliberations continued after two jurors were dismissed for illness and the COVID pandemic caused the shutdown of non-essential businesses. Ultimately, the jury was unable to decide all claims. The jury was unable to reach a verdict on two of three patent claims involving a patented method of operating gas separation equipment. The second trial on the two remaining patent claims, previously scheduled for August, is expected to occur this fall.
