Commenting on a recent Federal Circuit ruling allowing Apple and other tech giants to pursue a lawsuit targeting the Fintiv rule and the USPTO’s plans to publish an Advanced Notice of Proposed Rulemaking related to Fintiv, Washington, DC Principal Blair Jacobs predicted that the USPTO will likely adhere to Administrative Patent Act requirements with its rulemaking, which will moot the district court case that was allowed to proceed by the Federal Circuit. He added that the USPTO will receive comments from both sides but will likely implement a very similar rule to the current policy given that the issues have already been considered.
