Washington, D.C. principal Benjamin Levi published an article in Law360 titled “To CDO Or Not To CDO: Commissioners At ITC Are Split.” The article notes that one of the powerful remedies available from the U.S. International Trade Commission is a cease-and-desist order (CDO) and several recent decisions from the International Trade Commission have revealed a split among Commissioners regarding whether, and the circumstances under which, a CDO should be issued. Ben examines recent decisions in the context of the ITC’s issuance of CDOs to enforce trade statutes and protect the rights of IP holders.
