McKool Smith Principal Scott Kieff, a former commissioner of the International Trade Commission (ITC), recently published an article, “2 Things Missing From Debates On US-China Fights,” in Law360. The article discusses the new tariffs put in place by the US Presidential Administration against China. Scott points out an overlooked aspect of the potential harm China may be causing in the steel market, which is how the Chinese government is alleged to be using full-spectrum market manipulation on price and output to gather intelligence and later achieve its own national security goals. Scott also points out an overlooked solution, which is how commercial trials can help private companies more than tariffs can help those companies.
