Kate Falkenstien is an associate in McKool Smith Hennigan's Silicon Valley office. She focuses her practice on intellectual property and commercial litigation. Prior to joining the firm, Kate was a law clerk to Judge Sri Srinivasan on the D.C. Circuit. During law school, Kate also served as a summer law clerk in the San Jose U.S. Attorney's Office.
While attending law school, Kate was a Kirkland & Ellis Scholar and was awarded Gerald Gunther Prizes for Outstanding Performance in Administrative Law, Civil Procedure, Contracts, Criminal Law, Economic Analysis of Law, Property, Tax, and Torts. She served as the co-leader of the Parallel Justice pro bono group, which assists crime victims in obtaining restitution. Kate also participated in moot court, mock trial, a pro bono tax preparation program, and the Stanford Religious Liberties Clinic.
