On June 26, 2013, Judge Reed O'Connor of the U.S. District Court for the Northern District of Texas in Dallas issued a final judgment upholding a $15 million patent infringement award that McKool Smith secured on behalf of client Summit 6 against Samsung Electronics Co. Ltd. and Samsung Telecommunications America, Inc. The final judgment ordered an additional $1.8 million in prejudgment interest for a total award of $16.8 million.

The original $15 million verdict was handed down on April 5, 2013 after a six-day jury trial. The jury found that Samsung infringed Summit 6’s patented media uploading technology, U.S. Patent No. 7,765,482, which covers software that automatically processes digital photos before they are transmitted over a network by client devices, such as cell phones. Summit 6 accused Samsung phones that support MMS photo messaging of infringement.

The case is Summit 6 LLC v. Research In Motion Corp. et al., case number 3:11-cv-00367 in the U.S. District Court for the Northern District of Texas.
