Overview

Laura Baron is an Associate in McKool Smith's New York office. Laura's practice involves complex commercial litigation, including bankruptcy-related litigation, antitrust, and a wide range of financial and corporate disputes. Her practice also involves intellectual property proceedings in district courts and before the U.S. International Trade Commission and international arbitration panels, including trademark, patent, and copyright infringement and FRAND disputes. Prior to joining the firm, Laura clerked for the Honorable Nicholas G. Garaufis of the U.S. District Court for the Eastern District of New York. Prior to her clerkship, she was an associate with Cravath, Swaine & Moore, LLP.

Laura attended Columbia Law School where she was a Harlan Fiske Stone Scholar and served in leadership positions with the Columbia Law Women’s Association and the Journal of Gender and Law.

Representative Matters

Antitrust & Intellectual Property Litigation

  • Blue Cross Blue Shield Antitrust Opt-Out Litigation. Represent healthcare providers pursuing antitrust claims against Blue Cross Blue Shield health insurers, alleging the Blues defendants’ practices constitute antitrust violations. 
  • Ericsson v. Lenovo. Represented Ericsson in reaching a confidential partial settlement with Lenovo in a global patent licensing dispute involving a multi-year cross-license agreement, resulting in the withdrawal of all pending litigation and administrative proceedings, including before the USITC.
  • HTC v. EricssonRepresented Ericsson against antitrust claims brought by HTC involving a dispute over fair, reasonable, and non-discriminatory (FRAND) terms for licenses relating to standard essential cellular technologies. 
  • In re Pandora Media LLC Copyright Litigation.  Represented Spoken Giants, a global rights administration company for the owners and creators of Spoken Word copyrights, and secured dismissal, with prejudice, of antitrust claim filed by Pandora Media LLC.
  • Hy-Ko v. Hillman.  Represented defendant Hillman in a patent case related to key copying technology and obtained summary judgment dismissal of Lanham Act claims.
  • Nokia v. Acer, et al. Represented Nokia in USITC proceedings involving FRAND terms for licenses relating to video streaming technologies against Acer and Asus.

Bankruptcy Litigation

  • Matthew Dundon, as Trustee for Endo GUC Trust. Represent the Trustee of the Endo bankruptcy estate in litigation against over three dozen insurance company defendants in the Eastern District of Pennsylvania.  The action seeks insurance coverage for hundreds of millions of dollars of losses suffered by Endo due to liability related to certain of Endo’s opioid and other products.
  • Alan D. Halperin, as Trustee for Rite Aid Sub-Trust B. Represent the Trustee of the Rite Aid bankruptcy estate in pursuing insurance coverage claims against numerous insurers for Rite Aid’s opioid liability in the adversary proceeding in the United States Bankruptcy Court for the District of New Jersey and in state court proceedings in Delaware Superior Court.
  • Alan D. Halperin, as Trustee for the Tops Holding Litigation TrustRepresented the Trustee of the Tops bankruptcy estates in pursuing hundreds of millions of dollars of claims against the former owners and directors of the Tops grocery chain who orchestrated, authorized and received illicit dividends from the company in the adversary proceeding in the United States Bankruptcy Court for the Southern District of New York.

False Claims Act Litigation

  • Represent state attorneys general in investigations and litigation brought under state and local false claims act statutes.

Intellectual Property Litigation

  • Netflix v. Broadcom. Successfully obtained dismissal of multiple cases alleging patent infringement against Broadcom pursuant to 35 U.S.C. § 101.
  • TexasLDPC v. Broadcom. Successfully obtained dismissal of patent infringement claims against Broadcom on standing grounds pursuant to Fed. R. Civ. P. 12(b)(1).
  • USFL v. Fox SportsRepresented owners of the original United States Football League in trademark litigation against Fox Sports.

Pro Bono Matters

  • Assist pro bono clients in obtaining citizenship.
  • Litigate family court proceedings in partnership with Brooklyn Defender Services.
