Intellectual Property Litigation
In intellectual property cases, McKool Smith’s courtroom track record is unrivaled. Over the last five years, the firm has been recognized in The National Law Journal for winning more “Top 100 Verdicts” than any other law firm; the majority of these cases involved patent infringement litigation. The firm was named the South’s top patent litigation firm by Managing IP and received the publication's 2011 “Patent Case of the Year” honor for securing a substantial judgment for i4i Inc. against Microsoft. The judgment was unanimously affirmed by the U.S. Supreme Court, and reportedly represents the largest U.S. patent infringement award to be affirmed by the Supreme Court. In 2012, the firm was named intellectual property “Firm of the Year” by Benchmark Litigation, and previously was recognized as “IP Firm of the Year” by Law360.
We represent clients in all aspects of intellectual property litigation, including patent litigation, ITC/Section 337 disputes and investigations, copyright, trademark and false advertising litigation, and trade secret disputes. McKool Smith employs skilled and experienced trial lawyers with the legal and technical expertise necessary to persuade judges and juries who decide technologically complex issues. Many of our attorneys hold technical degrees and have previously worked as engineers and scientists, which offers clients an enhanced perspective in complex technological matters.
Our attorneys also represent clients in appeals before the U.S. Court of Appeals for the Federal Circuit. Ten of the firm’s attorneys are former Federal Circuit clerks, and our ranks include former U.S. Supreme Court, regional circuit, and district court clerks from across the country.
