McKool Smith has been recognized in The National Law Journal and VerdictSearch listing of the “Top 100 Verdicts” of 2012 for securing a $368 million jury verdict for VirnetX Holding Corporation in a patent infringement lawsuit against Apple Inc.

Every year, The National Law Journal's VerdictSearch affiliate scours court records to compile a listing of the nation's largest verdicts. McKool Smith's VirnetX verdict is ranked as the seventh largest verdict in the country during 2012.

The verdict was issued November 6, 2012 after a five day trial before Judge Leonard Davis of the U.S. District Court for the Eastern District of Texas-Tyler Division. Jurors awarded $368 million in damages to VirnetX in finding that Apple infringed four of the company’s patents which cover virtual private network (VPN) technology.

McKool Smith has secured twelve "Top 100 Verdicts" since 2007; more than any other law firm over the last six years. In addition to the VirnetX verdict, these victories include a $345 million verdict on behalf of Versata Software, Inc. against SAP America, Inc. and its parent company SAP AG; a $105.75 million verdict on behalf of VirnetX Holding Corporation against Microsoft; a $200 million verdict for i4i Inc. against Microsoft; a $59 million verdict for Pioneer Corp. against Samsung; and a $20 million verdict against online travel companies for more than 100 Texas cities, among many other courtroom wins.
