McKool Smith ranks as one of the top five firms in the nation for representing patent holders in IPR disputes according to a recent case study by Patexia, an online patent research platform. The report provides insights on 6,580 IPR challenges filed from 2012 through the first half of 2017.It also includes a ranking of the top 50 law firms and the top 50 attorneys in terms of IPR activity and performance. McKool Smith principal Robert Cote is ranked  #2 among the “Top 50 Best Performing Attorneys representing Patent Owners.”

McKool Smith’s recent patent holder PTAB victories include securing a complete defense win for Parallel Networks in an inter partes review trial against Microsoft and IBM concerning the validity of two Parallel Networks patents. The patents-in-suit were directed to systems and methods for managing dynamic web page generation requests. In the PTAB’s final decisions (available here), the Board found that Microsoft and IBM failed to prove the unpatentability of any of the Parallel Networks patent claims at issue in the proceedings.
