New York Associate Kevin Schubert will be speaking at the 2018 United States Patent and Trademark Office (“USPTO”) Post-Grant Trials program on September 21, 2018.  The event will be held at the Practising Law Institute in New York City.  Kevin will be speaking alongside former Chief Judge of the Federal Circuit Hon. Paul R. Michel (Ret.) and others knowledgeable about the USPTO post-grant review process. The event will be held before a live audience in New York City and broadcast to five other locations around the country.

Kevin will speak on “Recent Changes in IPR Estoppel in Concurrent District Court Litigation.”  The discussion will analyze recent district court decisions that take differing views on the reach of IPR estoppel in concurrent district court litigation.  The discussion will also address the recent SAS Institute Inc. v. Iancu, 584 U.S. ___ (2018) case and its impact on IPR estoppel in district court litigation.

Kevin's practice focuses on patent litigation.  Prior to joining McKool Smith, he worked for the USPTO as a patent examiner in the Cryptography department.
