McKool Smith Principals Kyle Lonergan, Joshua Newcomer and James Smith filed amended complaints against BakerHostetler and Brown & Fortunato in two trustee cases in the United States Bankruptcy Court Southern District of Texas. Representing a liquidating trustee of the Alliance Health Liquidating Trust, legal action targets BakerHostetler and Brown & Fortunato for fraudulent activities and malpractice, causing over $100M in damages.

The amended complaints are part of a larger effort to hold accountable those responsible for the fraudulent practices that led to the bankruptcy of Alliance Health. The involved law firms are being sued for damages and other forms of relief, and a jury trial is being sought to determine their liability.
