McKool Smith principal Scott Hejny shared his opinion in World IP Review’s article “USPTO’s Arthrex Guidance Offers Window into Agency’s Thinking.” Amid the speculations over the Supreme Court’s decision in US v Arthrex, the United States Patent and Trademark Office (USPTO) issued multiple updates to the guidance; yet, attorneys remain questionable towards the decision. On the note of political pressure, Scott commented that “[i]t will be interesting to see if perceived political pressure plays a role in which cases are selected for sua sponte director review since it appears that the advisory committee that evaluates whether a case should be subject to director review will not play a role in sua sponte decision-making process.” Read the article here.
