McKool Smith has successfully obtained full attorneys’ fees for Biote Medical, LLC, in a breach-of-contract suit. A Dallas jury granted the firm’s request for $4.67 million in fees, including potential costs for future appeals.

The lawsuit, initiated by Biote Medical against the company’s founder, Dr. Gary Donovitz, and his wife, reached a pivotal moment when Dr. Donovitz stipulated to liability on the breach-of-contract claims shortly before the trial was scheduled to commence. Despite this pre-trial concession, the challenge remained to justify the comprehensive fee claim to the jury.

The McKool Smith trial team, led by Principal Alan Loewinsohn, assisted by Gary Cruciani, Kerry Schonwald, and associate Jennifer Barall, navigated this hurdle, leading to the jury’s decision to award the full attorneys’ fees requested.
