Business Crimes Bulletin published an article in its November issue 2010 co-authored by Doreen Klein, senior counsel at McKool Smith, on White-Collar Court Cases and the judiciary. The article looks at the impact of several recent securities fraud cases. Klein argues that the courts are expanding the reach of some criminal statutes and are becoming more involved in proposed settlements between the government and private parties. According to the authors, the practical effect of this increased judicial scrutiny remains to be seen.
