McKool Smith principal Nick Matich spoke with Bloomberg Law on the Biden Administration’s moves to break apart from the previous administration’s approach to standard-essential patents (SEPs), becoming more favorable towards tech companies, such as Apple, Inc., that want to pay lower royalties on critical technologies and making SEPs more accessible. Nick noted, “[o]n balance the new administration is likely to be more receptive to implementer complaints that they have to pay too much.” In addition, tech companies are also lobbying for state laws that could consider tech companies’ view as anticompetitive behavior for patent owners.
