One of the panels on the first day of IPWatchdog LIVE 2022, "Gaming the Patent Litigation System: Value, Venue, Verdicts & Villains," examined the gamesmanship that transpires on both sides of the "v." The speakers on the panel agreed on a number of issues in the current iteration of the U.S. patent system that should be addressed to lessen uncertainty for all litigants, despite the fact that the panel included attorneys primarily representing either patent owners or district court defendants and Patent Trial and Appeal Board (PTAB) petitioners. McKool Smith Principal Nick Matich stated, "A company could have huge investments in Western Texas, thousands of employees within the district, and then they’ll win an argument on mandamus in which the Federal Circuit finds that it’s an abuse of discretion to say that it’s convenient to litigate there."
