Commenting on the train derailment in East Palestine Ohio, McKool Smith Principal Michael Miguel noted that the extent of the environmental damage might not be known “for a while,” comparing it to the coverage litigation during the 1990s and early 2000s relating to asbestos injury or environmental contamination claims where the offending activity took place decades earlier but didn’t manifest itself until much later. He added that “it's just a matter of scientific fact that if you introduce a toxic chemical into the ground, it takes time for it to find a pathway and migrate from where it was dropped."
