Commenting on an advance notice of proposed rulemaking issued by the U.S. Patent and Trademark Office regarding PTAB reforms, Washington D.C. Principal Nick Matich said that “it’s not terribly clear” which proposals will be adopted. He also noted that while “it would be far more preferable for Congress to work out some of the details through legislation,” “some of the issues that are addressed in the rulemaking may be necessary for the consistent functioning of the PTAB.” Regarding proposed changes to allow applicants to purchase increased word count limits, he noted that “if you allow parties to make as many arguments as they want, that tends to favor the wealthier parties.” Click here and here to read the full articles.
