Commenting on a recent PTAB decision finding a second VLSI microchip technology patent invalid, Washington, DC Principal Nick Matich said that “in almost any other kind of litigation” Intel would have been stuck with the jury verdict, “but here they get a second bite at the apple.” He added that VLSI’s appeals on this decision and a separate patent recently found invalid “will likely be consolidated” at the Federal Circuit.
