Warren Lipschitz

Warren Lipschitz is a nationally recognized trial lawyer who represents the world’s leading technology and telecommunications companies in complex patent and licensing disputes. His experience in large-scale, global disputes involving standard essential patents (SEPs) places him among a short list of the nation’s most experienced litigators for patent licensing matters concerning fair, reasonable, and nondiscriminatory (FRAND) terms.

Warren is recognized as a leading IP litigator by prominent legal directories such as Chambers USA, The Legal 500, Best Lawyers, Benchmark Litigation, and Lawdragon. He is also recognized in Managing IP, the IAM Patent 1000, and the IAM Strategy 300 guide to the world’s leading IP strategists.

Warren’s docket is split evenly between plaintiff and defense work, across technologies that include cellular standards, video technologies, medical devices, and software-related patents.

On the plaintiff side, Warren has won numerous patent infringement jury verdicts, including three judgments over $100 million. These successes, along with his victories as lead counsel for patent holders in district court and before the International Trade Commission (ITC), have earned him recognition as a “Plaintiff Trailblazer” from The National Law Journal. Warren specializes in developing worldwide licensing and enforcement strategies for standard essential patent holders against unwilling licensees, typically involving ITC investigations and district court cases. Warren has represented clients in such campaigns against major implementers including Lenovo, Samsung, Acer, Asus, Hisense, Paramount, Warner Bros., Amazon, HP, Snap, Disney, and TikTok.

On the defense side, Warren has won numerous defense verdicts in the Eastern District of Texas (EDTX). For example, Warren secured a complete defense verdict for Ericsson, Nokia, AT&T, Verizon, and T-Mobile in a $436 million cellular patent trial in EDTX. The jury found no infringement, invalidated all nine asserted claims, and found that the plaintiffs had breached their own FRAND licensing obligations. The victory followed back-to-back wins Warren co-led for T-Mobile and AT&T in EDTX, one cutting a $245 million demand to $2 million and the other a take-nothing verdict. He also successfully defended Ericsson in the first breach of FRAND jury trial for cellular patents, where the jury rejected HTC’s arguments and endorsed Ericsson’s royalty rate of $2.50 for each 4G cellular phone. The Fifth Circuit Court of Appeals upheld the verdict.

Warren graduated magna cum laude from Northwestern University School of Law, where he was elected to the Order of the Coif. He also has undergraduate and graduate degrees in civil and structural engineering, and before becoming a lawyer he practiced in Texas as a licensed Professional Engineer.

• AT&T, Verizon, T-Mobile, Nokia, and Ericsson. Secured a complete defense verdict for AT&T, Verizon, T-Mobile, Ericsson and Nokia in a consolidated 5G patent case in the Eastern District of Texas, defeating $436 million in claimed damages. The jury found no infringement, invalidated all nine asserted claims across all three patents, and held that the plaintiffs had breached their own FRAND licensing obligations.
• Daingean v. T-Mobile. Secured a significant patent defense verdict on behalf of T-Mobile in a dispute against Daingean Technologies for alleged infringement of a 5G telecommunications patent.
• Ericsson v. TCL. Represents Ericsson in matters involving patent infringement and a dispute over FRAND terms for a license relating to LTE, WCDMA, and GSM technologies. The cases are pending before district courts in Texas and California.
• University of Minnesota v. Ericsson. Represents Ericsson in a patent infringement action involving five patents related to LTE wireless technology.
• Red.com v. Nokia USA Inc. Defending Nokia in litigation filed by Red.com involving multiple patents dealing with compression algorithms for digital video cameras; currently pending in the Central District of California.
• Rockstar Consortium v. Google/Samsung. Represented Rockstar Consortium in a patent infringement suit against Google, Samsung, and others involving a number of patents related to mobile handset technology.
• Ericsson v. D-Link, et al. Represented Ericsson in its patent infringement action against Intel and a number of laptop and router manufacturers involving 802.11n wireless technology. At trial, the jury returned a verdict of infringement in favor of Ericsson on three patents and awarded a royalty.
• Ericsson v. Samsung (ITC). Represented Ericsson in a Section 337 action against Samsung involving several cellular and Wi-Fi standard essential patents. Participated in all aspects of the litigation, from filing through post-hearing briefing. The case was settled on terms favorable to Ericsson prior to initial determination.
• Zenith, et al. v. Craig Electronics. Represented defendants in a patent infringement lawsuit involving patents that were alleged to be essential to the ATSC HDTV standard.  The case was settled on terms favorable to defendants.
• Becton-Dickinson v. RTI. Represented a leading manufacturer of medical devices in antitrust litigation brought by a competitor.
