Law360 has reported on a recent patent defense verdict McKool Smith secured for AT&T against Daingean Technologies. After a five-day trial before Judge Gilstrap in the Eastern District of Texas, the jury found that Daingean failed to prove infringement of its telecommunications patent, ending the case without consideration of validity or damages.

Daingean initially filed suit against T-Mobile and AT&T in March 2023, alleging infringement of six 5G telecommunications patents related to the use of Ericsson and Nokia base stations. Ericsson and Nokia intervened in the case to defend their products and customers. Over the course of the litigation, Daingean dropped five of the six patents, ultimately proceeding to trial on a single claim from one patent, and seeking over $80 million in damages.

The result follows McKool Smith’s recent success defending T-Mobile against Daingean in an earlier patent case, underscoring the firm’s track record of securing high-stakes victories for major telecommunications clients.

The trial team included firm Principals Nicholas Mathews, Warren Lipschitz, Charles Fowler, Matthew Cameron, Josh Budwin, Jennifer TrueloveSam BaxterBlake Bailey. and Eric Hansen  and Associates Alexander ChernClare Churchman,  Kyra Cooper, and Christopher Leone. Co-Counsel included Deron Dacus from The Dacus Firm (for AT&T), and Andrew Gorbam, Melissa Smith, and J. Travis Underwood from Gillam & Smith LLP.
