McKool Smith secured a significant patent defense verdict on behalf of T-Mobile in a dispute against Daingean Technologies, an Ireland-based non-practicing entity that sued T-Mobile for alleged infringement of a 5G telecommunications patent.

The verdict was announced on July 11, 2025, following a five-day jury trial before Judge Rodney Gilstrap in the U.S. District Court for the Eastern District of Texas. After seven hours of deliberation, Jurors found that T-Mobile’s use of Nokia base stations did not infringe the Daingean patent and further determined that T-Mobile only needed to pay $2 million for its use of Ericsson base stations – significantly less than the $245 million Daingean sought at trial. 

Daingean originally sued T-Mobile and AT&T in March 2023 accusing the companies of infringement of six 5G telecommunications patents based on their use of Ericsson and Nokia base stations. Ericsson and Nokia intervened in the case to defend their customers and products. Over the course of the case, Daingean dropped five of the six patents, and was ultimately left with only one claim of one patent for trial. At trial, Daingean sought $245 million on the lone remaining claim.

The patent-in-suit is U.S. Patent No. 8,576,803. The case is Daingean Technologies Ltd v. T-Mobile USA, Inc., T-Mobile US, Inc., and Sprint Corp., case number 2:23-cv-00347, in the United States District Court for the Eastern District of Texas in Marshall.
